Terms & Conditions

Please read the following terms and conditions before placing your order.
Payment of your deposit is your confirmation that you understand and agree to these terms and conditions.
Please note where the word “cake” is used, this will also refer to all products that we provide.

1. Quotations:
1.1 Quotations are valid for 7 days.
1.2 Provision of a quotation is not considered confirmation of order.
1.3 Your deposit must be paid within 7 days of quotation to secure your required date; once this is received your order is considered confirmed.
1.4 In the event of your desired date becoming filled by another order/customer prior to your deposit being paid, we are not obliged to honour our quotation.
1.5 Please note our quotations are based on the flavour/design/size of cake that you order. We do not inflate prices based on the occasion.

2. Guarantee:
2.1 We promise to do everything in our power to provide a cake that exceeds your expectations. We will work with you on every level to make sure you are completely satisfied and happy with your cake. Please note that colours and design of actual cake may vary from on-screen images owing to the nature of digital and edible components.

3. Payment:
3.1 To secure your date, a deposit of 50% of the final balance is payable within 7 days of our quotation being issued.
3.2 Your order is considered confirmed once your non-refundable deposit has cleared our systems.
3.3 Any changes to your original order may be subject to additional charges – see section 9.
3.4 Your final balance must be paid 2 weeks prior to your event – failure to do so may result in your order being cancelled.
3.5 If your order is placed within 2 weeks of the date of your event, the full balance owed must be paid to secure your booking.
3.6 Payment can be paid either in cash or via bank transfer. Please advise your preference for more information.

4. Design & Specification:
4.1 Whilst we will do our utmost to make your cake to the design requested, please be advised we are unable to exactly duplicate other cakes. Artistic license will be used where necessary throughout the process, and you can rest assured your cake will be perfectly unique to your occasion.
4.2 Please ensure you have double-checked everything on your order form – day, date, time, location, flavour, colour, size, prices etc. We are not responsible for any problems caused by discrepancies realised at a later date.
4.3 Please be attentive to the fact that that whilst we can accommodate some dietary requirements, our kitchen uses a wide range of allergen products, including but not limited to: nuts, eggs, dairy and gluten. It is your responsibility to ensure your guests are aware of this.
4.4 Cake serving size estimations are calculated with use of the ‘Cake Slicer App’.
4.5 Standard sizings used are Coffee portions: 1inch x 1inch. Dessert portions: 2inch x 1inch. A cutting guide can be provided at your request. If you would like larger cake portions, please discuss with us prior to generation of your quote.

5. Fresh Flowers & Inedible Items:
5.1 If we/you choose to incorporate fresh flowers into your design, you acknowledge that they are not a food product, and may contain pesticides, insects, dirt, or other contaminants.
5.2 All fresh flowers used are supplied by reputable local florists and are taped and/or wired for support. If required, we will always endeavour to match other flowers at your event. Please supply us with your florists’ name and contact details at time of booking.
5.3 When removing fresh flowers please ensure they are disposed of correctly. Fresh flowers are purely decorative and are not for eating purposes.
5.4 Please be aware that toppers and moulded decorations often contain toothpicks, cake wire and/or polystyrene balls to give shape, support or to secure to the cake. Ensure the internal structures are removed prior to consumption. You will be advised in person where these are located on your cake if they have been used. No responsibility will be taken for any toppers eaten where the customer has not removed the internal structure.
5.5 Multiple tiered cakes will contain internal structures for support. These may include, but are not limited to, cake boards, wooden dowels and plastic dowels. Please ensure any structures are removed before serving. All structures used are food safe.

6. Photography, Marketing & Promotion:
6.1 We reserve the right to use any photographs for display, promotion and marketing purposes without any compensation to you.
6.2 With respect for your occasion, we will not publicise any images of your cake until one day after your event.
6.3 Sweet Dreams Desserts operates largely on word of mouth. We would appreciate your review and for you to share/tag yourself on our social media pages.

7. Delivery/Collection:
7.1 We highly recommend delivery and set up for multi-tiered cakes. Please note delivery fees may apply. Please provide delivery time/address for quote.
7.2 Should you opt to collect the cake from our studio, please bear the following in mind:
7.2.1 Accepting the cake indicates that the cake has been collected in excellent condition.
7.2.2 You assume all liability and responsibility of the cake once it leaves our Studio. We are not responsible for any damage after collection.
7.2.3 Your cake is fresh, delicate and perishable.
7.2.4 During transportation, the cake must be set on a flat level surface (ie. in the boot) with no paraphernalia close by that might slide/fall and damage the cake.
7.2.5 Ensure that your cake is not able to slide around – we recommend the use of non-slip matting.
7.2.6 You should keep the cake box out of direct sunlight – it WILL melt if in the sun. Use air-conditioning if the inside of the car is warm.
7.2.7 Drive slowly, carefully, and take corners very gently. Avoid bumps and rough roads.
7.3 If you choose delivery of your cake, please bear the following in mind:
7.3.1 Easy access to the venue must be provided, ie. close parking and elevator access to high level buildings.
7.3.2 The cake table must be prepared and in position in a cool safe place ready for delivery. The cake table should be level, stable, and decorated ready for the cake to be placed.
7.3.3 Where delivery has been pre-arranged, anyone at the delivery address who receives the cake is assumed to have been authorised by you. Receipt of the cake is deemed acceptance of the cake in excellent condition, and we are not responsible for any damage after delivery.
7.4 Once the cake is at your venue, please ensure the cake is stored correctly:
7.4.1 For outdoor occasions, the cake should remain in a cool, safe place until as close to serving as possible. Please bear in mind – weather, wildlife and other situations can be damaging to your cake, and we are not responsible for problems caused by venue conditions.
7.4.2 Indoors, the cake should be kept in a cool, dry, safe place, out of sunlight.
7.4.3 Fondant does not go in the refrigerator – be it a covered cake, decorations or models on the cake, or anything else, the fondant will go soft and wet if it is refrigerated, which will ruin the cake.

8. Equipment Hire:
8.1 We are able to supply you with equipment such as cake stands, serving utensils and crockery. A $100 deposit is required for all equipment hire. Please include your request on your enquiry form.
8.2 Hired equipment must be returned within 3 days of your event. After 3 days a fee of $20 per day will apply until the item/s are returned.
8.3 All returned items should be clean and free from damage. Equipment will be inspected and a refund of the deposit is based on the condition of the items.

9. Changes:
9.1 Any changes to your booking must be notified in writing a minimum of 2 weeks prior to your event. We endeavour to accommodate where possible, and we reserve the right to adjust our prices accordingly to reflect the changes.
9.2 In the event that we cannot reach an agreement based on revisions, normal cancellation procedures apply.

10. Postponement/Cancellation:
10.1 Please note your deposit is non-refundable.
10.2 Please advise in writing should you need to postpone your booking. Where possible, we will accommodate your change of date. Where we are unable to accommodate, we reserve the right to use our discretion with regards to any refund due.
10.3 Cancellations should be notified in writing as soon as possible. We reserve the right to use our discretion with regards to any refund due. Please note absolutely no refunds will be issued if your booking is cancelled within 14 days of the event date.
10.4 If we have to cancel your booking due to illness or other unforeseen circumstances, all monies paid will be refunded within 7 days to your designated bank account.

10.5 In the event your booking needs to be postponed your due to Covid-19 restrictions, please get in contact with us as soon as possible. We will try our best to work with you and your new date.

If you need to cancel your booking due to Covid-19 restrictions, please get in contact with us as soon as possible. Any refunds will be considered on a case by case basis.
 

11. Problems:
11.1 We are not liable for any delays owing to and not limited to accidents, disasters, inclement weather, illness, injury or death.
11.2 In the case of a problem with your cake, please contact us immediately so we can fix the issue. Our aim is for happy customers enjoying delicious cake, and if that does not happen, we would like the opportunity to rectify. If you are unhappy with your cake for any reason, please call us the day of your event and explain the situation so we may resolve it. In the rare case that you are unhappy with your cake and would like a refund, the original cake must be returned in full on the day of your event, or we are unable to refund any portion of your payment.

12. Pandemics / Covid-19

12.1 As Covid-19 rules and regulations are constantly changing,  will continue to be in contact with our customers, and work as hard as we can to make your order event as smooth as possible. We request that you keep up to date with the current regulations surrounding food (cake, etc) at your event. Sweet Dreams Desserts is not liable for any rules or regulations that are broken at your event where our food is served or on display.
